Yes, but laws themselves are created with a subjective element. Legislation is based on the votes and opinions of lawmakers. That's why we have courts and judges to "interpret" those laws, and various parties with different views as well. I mean, some extreme things are probably pretty clearly libelous or inciteful to most of us, or clearly fall on one side of the law, but lower on down the scale, someone had to draw that line somewhere. And that's where courts and judges come in.
For the less clear-cut cases, can something be deemed inciteful, for example, if no one was actually incited? (And how could you prove it either way?)
